Arbitration

Arbitration is less formal than a jury trial and mediation. Non-binding arbitration is governed by Section 44.103, Florida Statutes while binding arbitration is governed by Section 44.104, Florida Statutes.   Additionally, there are statutes and rules of procedure which dictate the who, when, where and how of arbitration.  See: Chapter 682, Florida Statutes and Florida Rules of Civil Procedure 1.800 and 1.820.

Additionally, the effects and enforceability of the arbitrator’s decisions are ruled within Florida law and could be found in Section 682.14-682.031.
